Terms of service
These Terms of Service (“Terms”) govern your access to and use of the Fricking Local Business Insights plugin (“Plugin”) and any related services offered at fricking.website (“Site”), operated by Martinez Calderon LLC, a single-member LLC doing business as Martinez Calderon Co. (“we,” “us,” or “our”).
By purchasing a license, activating a free trial, or downloading the plugin, you agree to these terms. If you do not agree, do not use the plugin.
1. What We Provide
Fricking Local Business Insights is a commercial WordPress plugin that enables agencies and consultants to scan Google Business Profiles, grade them using AI, capture leads, and generate market intelligence. We license the plugin to you; we do not sell it. You receive a non-exclusive, non-transferable right to install and use the plugin on WordPress installations you own or manage, subject to these terms.
2. Free Trial
We offer a 30-day free trial of the plugin’s premium features. No credit card is required to activate the trial. At the end of the trial period, access to premium features will require a paid license. We reserve the right to modify or discontinue the free trial at any time with reasonable notice.
3. Payments and Billing
Payments are processed by Paddle.com Market Limited (“Paddle”), which acts as the Merchant of Record for all purchases.
When you buy a license, your contract of sale is with Paddle, not with us. Paddle collects your payment information and issues your receipt. We never see or store your credit card details.
License fees, billing intervals, and any applicable taxes are as stated at the time of purchase on the checkout page. Prices are subject to change with advance notice. Continued use after a price change constitutes acceptance of the new pricing.
4. Acceptable Use
You may use the plugin for lawful commercial purposes. You may not:
Redistribute, resell, sublicense, or transfer your license to a third party
Reverse engineer, decompile, or extract the Plugin’s source code beyond what is permitted under the GPL-2.0+ license
Use the Plugin to scan businesses without a lawful basis for doing so
Use the Plugin in any way that violates applicable laws, including data protection and privacy laws in your jurisdiction
Attempt to circumvent license validation or activation mechanisms
5. Your Data
The plugin stores scan results, lead records, and settings in your own WordPress database. We do not have access to this data. All data collected through the plugin is your responsibility. You are solely responsible for complying with applicable privacy laws, including obtaining any required consent from individuals whose data you process.
When you uninstall the plugin or use the built-in deletion function, all plugin data stored in your database is permanently removed.
6. Third-Party Services
The plugin integrates with Google Places API and Anthropic’s Claude API. Use of these services is subject to their respective terms. You are responsible for obtaining and maintaining valid API keys and for any costs incurred through your use of those APIs. We are not responsible for changes to, or discontinuation of, third-party APIs.
7. Intellectual Property
The plugin is licensed under the GNU General Public License v2.0 or later (GPL-2.0+) for its core WordPress-compatible code. Our branding, design, documentation, and marketing materials remain our exclusive property. The GPL license does not grant rights to use our trademarks or brand assets.
8. Disclaimers
THE PLUGIN IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLUGIN WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT RESULTS OBTAINED FROM ITS USE WILL BE ACCURATE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLUGIN SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM. IN NO EVENT SHALL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
10. Termination
We may suspend or terminate your license if you breach these terms. You may cancel your license at any time through your Paddle customer portal. Upon termination, your right to use the plugin ceases. Sections on intellectual property, disclaimers, limitation of liability, and governing law survive termination.
11. Governing Law
These Terms are governed by the laws of Maryland, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Maryland, United States.
12. Changes to These Terms
We may update these terms from time to time. Material changes will be communicated by updating the effective date and, where practical, by direct notice. Continued use of the plugin after changes take effect constitutes acceptance.
